Please read these Terms of Service carefully before using ScriptsRx Direct. By accessing or using our services, you agree to be bound by these terms.

1. Acceptance of Terms
By accessing, browsing, or using the ScriptsRx Direct website (the "Site"), mobile applications, or any services offered through the Site (collectively, the "Services"), you ("User," "you," or "your") acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, HIPAA Notice of Privacy Practices, and Disclaimer, all of which are incorporated herein by reference. If you do not agree to these Terms, you must not access or use the Services.
ScriptsRx Direct is operated by Breakthrough Health LLC, a Missouri limited liability company ("Company," "we," "us," or "our"). The Company provides a technology platform that facilitates connections between patients and licensed healthcare providers for telehealth consultations, and between providers and licensed compounding pharmacies for prescription fulfillment.
2. Nature of Services
2.1 Platform Services
ScriptsRx Direct is a technology platform that provides marketing, informational, and administrative services. The Site facilitates:
- Educational information about compounded medications, peptide therapies, hormone replacement therapy, and weight management options
- Connection to licensed healthcare providers for telehealth medical consultations
- Administrative processing of orders for prescription medications
- Communication between patients, providers, and pharmacy partners
2.2 Not a Healthcare Provider
ScriptsRx Direct is NOT a healthcare provider, medical practice, pharmacy, or medical group. We do not practice medicine, diagnose conditions, prescribe medications, or provide medical advice. All clinical decision-making, including the decision to prescribe any medication, rests solely with the licensed healthcare provider conducting your medical evaluation. The Company, its officers, employees, and affiliates do not exercise any control over the medical judgment of any healthcare provider.
2.3 Telehealth Services
Medical consultations are provided by independently licensed healthcare providers or provider groups who are licensed to practice medicine in the state where the patient is physically located at the time of the telehealth visit. All telehealth services are conducted in accordance with applicable state and federal telehealth regulations. The provider-patient relationship is established directly between you and the treating provider, not with ScriptsRx Direct.
2.4 Prescription Medications
All prescription medications available through the Services require a valid prescription from a licensed healthcare provider following a medical evaluation. No medication will be dispensed without a provider determining medical appropriateness. The availability of any product on the Site does not guarantee that a prescription will be issued — that determination is made solely by the treating provider based on your individual medical history, current health status, and clinical judgment.
3. Compounding Pharmacy Disclosures
3.1 503A Compounding Pharmacies
All prescription medications ordered through ScriptsRx Direct are compounded by licensed and accredited 503A compounding pharmacies. These pharmacies are:
- Licensed by the state board of pharmacy in the state(s) in which they operate
- Licensed in the state of residence of the patient, or the state in which the telehealth patient is physically located during the time of their visit
- Compliant with applicable United States Pharmacopeia (USP) standards, including USP <795> (non-sterile compounding) and USP <797> (sterile compounding) as applicable
- Subject to state and federal regulatory oversight
- Accredited by recognized pharmacy accreditation bodies where applicable
3.2 Compounded Medications Are Not FDA-Approved
Compounded medications are not FDA-approved. The U.S. Food and Drug Administration (FDA) does not verify the safety, efficacy, or manufacturing quality of compounded medications. Compounded medications are prepared pursuant to a valid prescription for an individual patient based on the prescriber's clinical judgment that the compounded preparation is medically necessary. The decision to prescribe a compounded medication is made solely by the treating healthcare provider.
3.3 Product Quality
All products dispensed through our pharmacy partners are:
- Made to use — ready for patient administration
- Supplied with all necessary administration supplies, including syringes where applicable
- Verified by a licensed pharmacist prior to dispensing
- Manufactured at 503A licensed and accredited compounding pharmacies
ScriptsRx Direct does not partner with, distribute, or work with any "Research Use Only" or "Professional Use Only" products. All products are intended for patient use pursuant to a valid prescription.
4. Medical Disclaimer
4.1 No Medical Advice
The information provided on the Site, including but not limited to product descriptions, mechanism of action descriptions, dosing information, clinical references, and educational content, is provided for informational and educational purposes only. This information does not constitute medical advice, diagnosis, or treatment recommendations. Always seek the advice of a qualified healthcare provider with any questions you may have regarding a medical condition or treatment.
4.2 Clinical References
Where clinical studies or research are referenced on the Site, such references are provided for educational context only. References to observational studies, preclinical research, or real-world data do not guarantee similar results for any individual patient. Individual results vary significantly based on factors including but not limited to starting health status, adherence to treatment, diet, exercise, genetics, and other medical conditions.
4.3 Provider Authority
All medical decision-making rests solely with the prescribing healthcare provider and/or provider group. The provider has sole authority to:
- Determine whether any medication is medically appropriate for a patient
- Select the specific medication, formulation, and dosing
- Decide whether to prescribe, modify, or discontinue any treatment
- Order and interpret laboratory tests
- Refer patients to other healthcare providers or specialists
5. Eligibility and Account Requirements
5.1 Age Requirement
You must be at least 18 years of age to use the Services. By using the Services, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.
5.2 Accurate Information
You agree to provide accurate, current, and complete information during registration, medical intake, and throughout your use of the Services. You are responsible for maintaining the accuracy of your information. Providing false, misleading, or incomplete medical information may result in inappropriate medical treatment and poses serious health risks.
5.3 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
6. Pricing, Payment, and Refund Policy
6.1 Pricing
All prices displayed on the Site are in U.S. dollars and are subject to change without notice. Prices include the cost of the medication, provider consultation, administrative services, and technology platform fees. Shipping costs may apply and will be disclosed at checkout.
6.2 Payment
Payment is required at the time of order placement. We accept major credit cards and other payment methods as displayed at checkout. By providing payment information, you represent that you are authorized to use the payment method.
6.3 Self-Pay Disclosure
All services provided through ScriptsRx Direct are self-pay. We do not accept insurance, Medicare, Medicaid, or any other third-party payer. You acknowledge that you are paying for the all-in expense of the provider consultation, the provider group, the service, system access, administrative support, and the cost of prescription medication (if prescribed).
6.4 Refund Policy
Due to the nature of prescription medications and medical services, refunds are limited. If a provider determines that a medication is not medically appropriate for you and no prescription is issued, you will receive a refund for the medication cost. Consultation fees are generally non-refundable once a medical evaluation has been performed. Medications that have been compounded and shipped cannot be returned or refunded due to safety regulations.
7. Shipping and Delivery
Prescription medications are shipped directly from our licensed pharmacy partners via expedited shipping with appropriate handling (including cold-chain for temperature-sensitive medications). Shipping timelines are estimates and may vary. ScriptsRx Direct is not responsible for delays caused by carriers, weather, or other circumstances beyond our control.
8. Product-Specific Disclosures
8.1 GLP-1 and GIP/GLP-1 Receptor Agonists (Semaglutide, Tirzepatide)
Compounded semaglutide and compounded tirzepatide are not FDA-approved medications. These are compounded preparations of the active ingredients prepared by licensed 503A pharmacies pursuant to valid prescriptions. These medications carry boxed warnings regarding thyroid C-cell tumors and are contraindicated in patients with a personal or family history of medullary thyroid carcinoma (MTC) or Multiple Endocrine Neoplasia syndrome type 2 (MEN 2). They should not be used during pregnancy or breastfeeding. Common side effects include nausea, diarrhea, vomiting, constipation, and decreased appetite. Serious side effects including pancreatitis, gallbladder disease, and kidney injury are possible.
8.2 Peptide Therapies
Peptide therapies offered through the Site (including but not limited to BPC-157, TB-500, CJC-1295/Ipamorelin, Sermorelin, NAD+, GHK-Cu, PT-141, and others) are compounded preparations. Many peptides have primarily preclinical (animal model) research supporting their use. The clinical evidence base varies by peptide. Your provider will discuss the available evidence and potential risks during your consultation.
8.3 Hormone Replacement Therapy (HRT)
Testosterone replacement therapy (TRT) and women's hormone replacement therapy carry specific risks that will be discussed by your provider. TRT may affect fertility and sperm production. Women's HRT carries risks that vary based on the type of hormones, dosing, timing of initiation, and individual risk factors. Regular laboratory monitoring is required for all HRT patients.
9. State and Federal Regulatory Compliance
9.1 Telehealth Regulations
All telehealth consultations are conducted in compliance with applicable state and federal telehealth laws and regulations. Providers are licensed in the state where the patient is physically located at the time of the consultation. Telehealth services may not be available in all states.
9.2 Pharmacy Regulations
All compounding pharmacies partnering with ScriptsRx Direct are licensed in accordance with state board of pharmacy requirements and comply with applicable federal regulations under Section 503A of the Federal Food, Drug, and Cosmetic Act. Pharmacies maintain appropriate state licenses for dispensing to patients in the states they serve.
9.3 Advertising Compliance
The Site and its content are designed to comply with applicable FDA, FTC, and state advertising regulations for prescription medications and telehealth services. Product information is provided for educational purposes. We do not make specific claims about guaranteed outcomes, weight loss percentages, or treatment results. All marketing content is subject to review for regulatory compliance.
9.4 Controlled Substances
ScriptsRx Direct does not facilitate the prescribing, dispensing, or distribution of controlled substances as defined by the Drug Enforcement Administration (DEA) or applicable state law.
10. Intellectual Property
All content on the Site, including text, graphics, logos, images, software, and compilation thereof, is the property of ScriptsRx Direct or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content without our express written permission.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SCRIPTSRX DIRECT, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY.
ScriptsRx Direct is not liable for any medical decisions made by healthcare providers, any adverse reactions to medications, any delays in shipping or delivery, or any actions or omissions of third-party pharmacy partners. Our total liability for any claim arising from or related to the Services shall not exceed the amount you paid for the specific service giving rise to the claim.
12. Indemnification
You agree to indemnify, defend, and hold harmless ScriptsRx Direct, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; (d) any inaccurate or incomplete information you provide; or (e) your infringement of any third-party rights.
13. Dispute Resolution
Any dispute, controversy, or claim arising out of or relating to these Terms or the Services shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules. The arbitration shall be conducted in St. Charles County, Missouri. The arbitrator's decision shall be final and binding. You agree to waive any right to a jury trial or to participate in a class action lawsuit.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Missouri, without regard to its conflict of law provisions. Any legal action not subject to arbitration shall be brought exclusively in the state or federal courts located in St. Charles County, Missouri.
15. Modifications to Terms
We reserve the right to modify these Terms at any time. Changes will be effective upon posting to the Site with an updated "Last Updated" date. Your continued use of the Services after any modification constitutes your acceptance of the modified Terms. We encourage you to review these Terms periodically.
16. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.
